Bellevue’s city council decided on the eve of election night to extend the public hearing on an appeal that will determine the fate of Kemper Development’s proposed downtown helistop.

Two appellants – Su Development and a group of downtown residents – have appealed the hearing examiner’s decision to grant a conditional-use permit for the helicopter landing station at the Bellevue Place Bank of America building.

The City Council is responsible for making a ruling in the matter.

Lawyers for Kemper Development asked the council to dismiss Su’s case because he didn’t file a completed appeal statement until 84 days after the deadline of Aug. 3.

The council decided to toss out Su’s final appeal statement and confined his case to an outline received Aug. 3.

Su claims he couldn’t file more than an outline for the deadline because the hearing examiner’s record was not available at that time. Those documents came out in September, and Su filed his full appeal statement Oct. 26.

A brief filed Oct. 28 by Su’s attorney will also be considered in the appeal. It contains some of the same information included in Su’s final appeal statement.

Kemper Development requested more time to prepare a response to the brief. The council agreed to allow a five-page response that was due Nov. 9.

The council is scheduled to hold deliberations over the appeal at 8 p.m. on Nov. 16 at City Hall.

“I think they’d like to make a decision before the new council members are sworn in,” said Bellevue city attorney Lori Riordan. “I’m assuming they would want to wrap this up pretty quickly.”
